Genie SmartCare – Terms of Service

Effective Date: 5 October 2025

These Terms of Service govern the use of Genie SmartCare provided by Genie Health Pte. Ltd. By accessing or using the Services, you and the healthcare, wellness, fitness, diagnostic, or other approved institution you represent agree to these Terms.

Definitions

Client: Healthcare, wellness, fitness, diagnostic, or other approved organizations using Genie SmartCare.

End-Users: Patients, customers, or individuals served by the Client.

Services: Genie SmartCare (B2B offerings) including features, integrations, and functionality.

1. Scope of Services and Critical Disclaimers

Genie SmartCare provides Smart Scheduling, Smart Messaging, and Smart Insights for client and end-user engagement. The services are non-clinical tools for administrative efficiency. Genie Health is not a healthcare provider and provides no medical advice, diagnosis, or treatment.

2. Client Obligations and Compliance

Clients must use Services lawfully, ensure End-User consent, comply with third-party policies (including WhatsApp), avoid prohibited data transmission, and maintain account security.

3. Data Protection and Roles

The Client remains the Data Controller under PDPA. Genie acts as a Data Intermediary (Processor) implementing safeguards in line with PDPA and industry best practices.

4. Third-Party Services and Liability

Services may rely on third-party integrations. Genie is not responsible for third-party stability, security, or privacy practices.

5. Indemnification and Limitation of Liability

Client agrees to indemnify Genie from claims arising from misuse, non-compliance, or violations. Genie's liability is limited to fees paid in the preceding six months.

6. General Provisions

Non-payment may result in suspension. Either party may terminate with notice. Terms are governed by Singapore law.
